On July 16, 2025, Italian UN judge Francesco Buffa of the UN Dispute Tribunal issued a judgment that rescinded the administrative leave placed on Mr. Samarasinha in May 2023. The ruling ordered his full reinstatement, including back pay and entitlements, unequivocally stating that the internal investigation constituted a due process violation and lacked substantiation for the allegations.
The situation originated during Mr. Samarasinha’s time as the UN Resident Coordinator in the Pacific, where he acted as the Secretary-General’s highest-ranking representative for ten island nations. Public records indicate that he is a UN veteran with over 25 years of service in more than 40 countries, focusing his career on crisis management, human rights, and sustainable development in challenging regions like Myanmar, Iran, Kosovo, Belarus, Liberia during the Ebola pandemic, and post-Tsunami Sri Lanka.
The Tribunal’s examination uncovered significant flaws in the investigative process. Judge Buffa, who serves as both a justice of the Italian Supreme Court and for the United Nations, determined that the evidence presented by investigators lacked the necessary coherence and substantiation to support the charges. A notable finding by the Tribunal was that none of the 96 witnesses Mr. Samarasinha provided to corroborate his account were interviewed by the investigators. The judgment characterized the inquiry as rushed and procedurally unsound, further criticizing the administration for not investigating his credible counter-allegations concerning false reporting, political motives, and collusion.
This legal victory in Geneva is strongly reinforced by a ruling from the Warsaw District Court on April 2, 2025. In a defamation lawsuit filed by Mr. Samarasinha against Euroradio, the court issued a one-year injunction, halting the publication of two articles considered inflammatory and unsubstantiated. The presiding judge concluded that the headlines were sensationalist and the content lacked factual basis, resulting in significant and undue reputational damage without a clear public interest justification. The court reconciled freedom of expression with individual dignity, limiting the restriction to the specific articles while declining broader censorship.
The UN administration retains the option to appeal the Geneva judgment, potentially prolonging the legal proceedings. However, as noted by a former UN senior official, “Sanaka can find reassurance that two independent courts have already declared him innocent of these allegations.” The official added, “He and his family can now move past this terrible ordeal.” Mr. Samarasinha could not be reached for comment.
Concurrently, Mr. Samarasinha has initiated two civil defamation lawsuits in the Colombo District Court of Sri Lanka. These cases are anticipated to conclude shortly and may further influence his public standing.
