
(AsiaGameHub) – Kalshi has initiated a federal lawsuit against Minnesota. This action follows the state’s enactment of a second bill pertaining to prediction markets, further intensifying the already intricate situation surrounding the industry’s future in the United States.
The lawsuit by Kalshi comes after the Commodity Futures Trading Commission (CFTC) filed its own legal challenge against Minnesota regarding provisions contained within SF 4760, a bill signed by Governor Tim Walz.
Governor Walz also approved SF 3432 on May 26, which modifies certain aspects of the earlier legislation and expands Minnesota’s broader public safety measures. Kalshi aims to block this new law before its scheduled effective date of August 1.
The company has named Tim Walz, Attorney General Keith Ellison, and Jon Anglin, Director of the Alcohol and Gambling Enforcement Division, as defendants in the case.
Kalshi argues that the Commodity Exchange Act grants the CFTC exclusive authority over prediction markets. The lawsuit contends that Minnesota is attempting to override federal jurisdiction and prohibit specific categories of event contracts.
Kalshi claims the state is endeavoring to label the company as “a felon in Minnesota” for offering contracts through its federally authorized designated contract market (DCM). They describe SF 3432 as “a targeted attack on federal DCMs” and believe the law will effectively ban all platform offerings.
Kalshi states that several federal courts support federal preemption claims concerning prediction markets. They assert that Minnesota cannot prohibit advertising for these services, as they are legal under federal law. Moreover, they believe Minnesota is interfering with their established authority in the market.
These new regulations and restrictions are expected to impact traditional derivatives markets, particularly those linked with agricultural weather trading.
This dispute is, in fact, a component of a larger global struggle within the prediction market industry. Similar ongoing legal conflicts are occurring in Arizona. Rhode Island has agreed to cease further actions against Kalshi and Polymarket, acknowledging the involvement of federal cases.
