Truth Bursts Forth, Too Outlandish for Concealment

Kuala Lumpur, Malaysia Dec 3, 2025  – A small contingent of approximately 10 parcel owners has initiated 8 legal disputes against a property developer and its Joint Management Body (JMB), described as remarkably coordinated. These cases reportedly feature unusual judicial aspects and rulings that seemingly diverge from fundamental principles of due process and established facts. Despite the outcomes and decisions across these eight cases in both Tribunal and Judicial courts highlighting numerous unexplained inconsistencies, the developer expresses continued faith in the Malaysian legal system and the ultimate justice of God Almighty, which is believed will ultimately be established.

An independent observer characterized the extensive litigation, launched by a mere handful of unit owners, as relentless persecution targeting a developer considered among the most reputable, if not the most reputable, in the industry. This situation raises questions about potential underlying motives. It is deemed inexplicable that a group of seemingly ordinary individuals would pursue such extensive action over minor or even beneficial issues.

It is considered incomprehensible that they could file their case alleging “suspected wrongdoings” in the activities and accounts of the JMB, an accusation dismissed as absurd. Legal and fairness principles mandate that any accusation must be specific and credibly substantiated before it can be considered valid. In this instance, the Plaintiffs reportedly failed to present even one credible, or even questionable, example of actual wrongdoing.

Such vague, unspecific accusations are considered meritless, yet it is reportedly strange that their lawyer allowed these claims. If permitted to continue, this and similar cases would result in significant and unnecessary expenditure of court, defendant, and community resources. The developer holds a firm belief that higher courts will recognize the fundamental flaw in permitting litigation based on unprincipled accusations and mere suspicion, rather than on reasonable, rational complaints and verifiable facts.

Despite what are described as their bizarre, outrageous, and unsustainable accusations, their petitions were granted, even if overtly flawed. In one recent case, the plaintiffs presented twenty-two specific claims, yet the final judgment included an additional ruling, appearing unexpectedly. Paragraph 95 of the Grounds of Judgment stated, “The Court finds that the 1st Defendant (JMB) has acted unlawfully by calculating maintenance charges based on varied square footage/meters and imposing different maintenance rates for different parcels.”

This crucial point was neither claimed nor deliberated during proceedings, yet emerged as “unlawful” without prior discussion. The Appeal Court is expected to address this correction.

Another notable anomaly concerns the rejection of an application by a substantial group of 274 parcel owners, representing over half of the total, who sought to intervene on February 6, 2021. The imposition of RM 5,000 in costs for their intervention attempt is deemed contrary to common sense, especially given they now face consequences from a case they opposed.

This ruling, which effectively silenced the collective will of the significant majority in favor of minority litigants, warrants review on appeal.

The inherent contradiction within the Plaintiffs’ approach was further revealed when their own legal representatives petitioned the judge to declare that the JMB had committed no wrongdoing and should not be liable for the RM 100,000 in costs awarded to the Plaintiffs. This prompts a fundamental question: How did the case even commence if the JMB was without fault, implying it lacked a legal basis?

In a truly surprising and perplexing development, the Plaintiffs successfully convinced the judge that the JMB was blameless, yet all other defendants were made to bear the full impact of their unsubstantiated accusations.

To exacerbate the situation, the Plaintiffs’ request for significant interventions—namely, the freezing of accounts, the appointment of an administrator, and the instruction for a forensic audit—was granted. The decision to approve such severe measures, particularly when no concrete wrongdoing had been established, and indeed, despite the majority of claims being overwhelmingly refuted by documentation and majority vote, is seen as baffling and disproportionate.

Consequently, the Defendants were compelled to seek a stay of the order and immediately file an appeal. In a further demonstration of what many perceive as a lack of consideration, one of the Plaintiff-deponents submitted a lengthy affidavit opposing the stay, asserting that the Defendants’ necessary actions had inflicted “hardship, confusion, prejudice, misery, and harm” upon the Plaintiffs. This claim reportedly highlights the ethical stance and perceived unconscionable traits of the Plaintiffs, who have pursued over eight separate cases against the Defendants, yet claim to be the ones enduring hardship and misery.

The legal proceedings are now advancing to the Appeal Court, where the defendants express full confidence that the reliable Malaysian legal system and its fair judges will rectify all errors in the case. Following a thorough review of the cases, the independent observer affirmed that the developer, who has been subjected to harsh treatment in this instance, remains resolute and trusts that its reputation will be fully restored. This developer has consistently demonstrated high integrity, a fact reinforced by over two decades of industry experience.

Mr. Peter Chan’s prophetic words resonate with renewed emphasis: “Justice will be revealed and prevail. The villains and minions will grind their teeth and fade away!” The pursuit of this vindication at the Appeal Court is considered a crucial step toward safeguarding the honor, integrity, and operational legitimacy of the developer, the entire JMB community, and, indeed, most significantly, of the nation!
